TERMS AND CONDITIONS

1. Booking & Deposit Policy

  • Reservation: A booking is considered confirmed only upon receipt of the initial deposit and written confirmation from Rell Adventure Solutions.

  • Deposit Requirements:

    • 1-day tours/excursions: 10% deposit per person.
    • 2–3-day safaris/tours: 20% deposit per person.
    • 4–6-day safaris/tours: 30% deposit per person.
    • 7–12 day safaris/tours: 40% deposit per person.
    • Cross-border / Multi-country tours: 50% deposit per person.
  • Balance Payment: The remaining balance must be paid at least 30 days prior to the scheduled departure date. For bookings made within 30 days of departure, full payment is required immediately upon booking.

2. Payment Methods & Currency

  • Payments are accepted in USD or local currency (KES) as quoted in the invoice.
  • Payments may be made via direct bank transfer (EFT/Wire) or authorized credit/debit card payment channels.
  • Bank transfer charges or credit card handling fees levied by your processing bank are the responsibility of the client.

3. Cancellations & Refunds by the Client

All cancellation notices must be submitted in writing via email. Cancellations are subject to the following charges based on the date written notice is received prior to tour commencement:

.. Alterations & Route Changes

  • By the Client: Any requested change to confirmed itineraries, accommodations, or dates is subject to availability and any price difference or supplier adjustment fees.
  • By the Company: Rell Adventure Solutions reserves the right to adjust itineraries, substitute hotels/lodges with properties of comparable standard, or modify transport arrangements due to adverse weather, road conditions, airline schedule shifts, or unforeseen operational factors.

5. Inclusions and Exclusions

Standard Inclusions:

  • Accommodation as specified in the agreed itinerary.
  • Transport in standard safari vehicles (4x4 Land Cruisers or safari minibuses) driven by professional guide/drivers.
  • Meals as indicated in the itinerary.
  • Park entry, reserve, and conservation fees.
  • Bottled mineral water during transit/game drives.

Standard Exclusions:

  • International airfares, visa fees, and airport departure taxes.
  • Personal travel and medical insurance.
  • Tips and gratuities for driver-guides, lodge staff, or porters.
  • Items of a personal nature (laundry, alcoholic beverages, phone calls, optional excursions).

6. Wild Animal Risks & Outdoor Safety

  • Safaris and outdoor adventure activities involve inherent risks when traveling through natural habitats.
  • Many safari lodges and tented camps are unfenced, allowing wildlife to move freely. Guests must strictly follow all safety briefings and rules provided by camp management and guides.
  • Neither Rell Adventure Solutions nor its representatives shall be held liable for personal injury, illness, or incident arising from wild animal encounters or outdoor adventure activities.

7. Travel Insurance

  • Comprehensive travel insurance is mandatory for all guests traveling with Rell Adventure Solutions.
  • Your insurance policy must cover emergency medical evacuation, personal accident/injury, medical expenses, luggage loss/delay, and trip cancellation/curtailment.

8. Health, Passports, Visas & Luggage

  • Health Requirements: Guests are responsible for meeting health and vaccination entry criteria (e.g., Yellow Fever, COVID-19 guidelines where applicable). Guests with dietary requirements or medical conditions must inform us prior to departure.
  • Passports & Visas: Passports must be valid for at least 6 months beyond the intended date of departure. Obtaining appropriate visas is the sole responsibility of the traveler.
  • Luggage Limits: Soft duffel bags are strongly recommended. On internal/charter flights, luggage is strictly limited to 15 kg (33 lbs) per person including hand luggage.

9. Force Majeure & Limitation of Liability

  • Rell Adventure Solutions acts as an agent for airlines, hotels, lodges, and third-party contractors and cannot be held liable for any injury, loss, damage, delay, or irregularity caused by default, negligence, or failure of third-party suppliers.
  • The company is not liable for failures or delays resulting from events beyond its reasonable control (Force Majeure), including acts of God, civil unrest, war, strikes, government restrictions, severe weather, or natural disasters.

10. Governing Law & Jurisdiction

  • These terms and conditions are governed by and construed in accordance with the laws of the Republic of Kenya.
  • Any dispute arising under or in connection with this agreement shall first be addressed through good-faith negotiation or arbitration. If unresolved, litigation shall fall under the exclusive jurisdiction of the courts located in Kenya.
